Last Updated: [2023]
1. Our Commitment to Intellectual Property
UDCourse respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act (17 U.S.C. § 512, the “DMCA”) and applicable copyright law in the United Kingdom, the European Union, and other jurisdictions where we operate.
2. Reporting Copyright Infringement
If you believe that any material available on udcourse.com infringes your copyright, you may submit a written notice of claimed infringement to our designated agent at the email address below. To be effective, your notice must include all of the following:
- A physical or electronic signature of the person authorised to act on behalf of the owner of the exclusive copyright that has allegedly been infringed.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).
- Identification of the material that is claimed to be infringing, including its URL on udcourse.com or other information sufficient to enable us to locate the material.
- Sufficient contact information so that we can reach you — including a valid email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorised to act on behalf of the owner.
3. Where to Send Your Notice
Send your DMCA notice to:
DMCA Designated Agent — UDCourse
Email: help@udcourse.com (subject line: “DMCA Notice”)
Please use email for the fastest response. We typically review valid notices within 1-2 business days.
4. Our Response
Upon receipt of a notice that meets the requirements above, we will:
- Remove or disable access to the material that is alleged to be infringing, where appropriate.
- Notify any responsible party where applicable.
- Take reasonable steps to prevent re-uploading of the same material.
- Terminate accounts of repeat infringers in appropriate circumstances.
5. Counter-Notices
If you believe that material you provided was removed or disabled in error or as a result of misidentification, you may submit a counter-notice including:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the courts of your judicial district (or, if outside the United States, the courts of England and Wales) and that you will accept service of process from the party who provided the original notice.
Send counter-notices to the same address as DMCA notices in Section 3 above.
6. Misrepresentations
Under Section 512(f) of the DMCA, you may be liable for damages — including costs and attorneys’ fees — if you knowingly materially misrepresent that material is infringing, or that material was removed or disabled as a result of mistake. We recommend that you consult a lawyer before submitting a notice or counter-notice.
7. Repeat Infringer Policy
In appropriate circumstances and at our discretion, we will terminate the accounts of users or sellers who are determined to be repeat infringers.
8. Updates to This Policy
We may update this DMCA Policy from time to time. The updated version will be indicated by a new “Last Updated” date at the top of this page.
